Every Promise to Purchase shall include the following conditions:
– The undivided co-ownership percentage (unit allocation) indicated in the MLS listing is provided for information purposes only and shall be confirmed upon completion of the cadastral subdivision of the property.
– The co-property fees indicated are projected estimates only. The final amount of the common expenses shall be officially determined by the condominium syndicate upon its constitution and at its first meeting of co-owners.
– The municipal and school taxes indicated are projected estimates only. The final tax amounts shall be established following the issuance of the municipal assessment applicable to each private portion after completion of the cadastral subdivision of the lots.
– The notary acting for the execution of the Deed of Sale shall be designated by the Seller.
– Any Promise to Purchase should be conditional upon the completion of the cadastral subdivision of the property into commercial divided co-ownership, the registration of the Declaration of Co-ownership, and the delivery, for each private portion forming the subject of this Promise to Purchase, of a certificate of location reflecting the current state of the premises, all at the Seller’s expense.
The Buyer acknowledges that the areas, dimensions, boundaries, and cadastral designations of the private portions described herein are approximate and subject to change following the final survey plans, cadastral subdivision, and Declaration of Co-ownership. Any reasonable modifications resulting from these processes shall not affect the validity of this Promise to Purchase, nor entitle the Buyer to any reduction in the purchase price or termination of this Promise to Purchase, except where such modification is substantial and materially affects the subject matter of the transaction.
– The Buyer acknowledges that the common parking area will be subdivided into exclusive-use parking spaces, with each private unit being allocated a specific number of parking spaces. The exact allocation and designation of such exclusive-use parking spaces shall be determined by the Seller as part of the cadastral subdivision
– The sale shall be made without any legal warranty of quality, at the Buyer’s sole risk and peril.
